Welcome to our website (“Website”). Your browsing and use of this Website shall constitute your agreement to comply with and be bound by these terms and conditions (“Terms”).

The “Restaurant” or “us” or “we” refer to The Chairman Company Ltd, the owner of this Website. The term “you” refers to the user or viewer of this Website.

 

The use of this Website, including without limitation your use of online reservation, is subject to the following:

·   The content of this Website is for your general information only. It is subject to change by us with or without notice.

·   We do not warrant nor guarantee the accuracy, timeliness, completeness or suitability of the information and materials on this Website. If any such information and materials contain any inaccuracies or errors, we exclude liability for any direct or indirect losses or inconvenience caused to you and any other persons, to the fullest extent permitted by law.

·   This Website contains material which is owned by or licensed to us. Such material includes, but is not limited to, the design, layout, look, appearance and graphics. Reproduction or unauthorized use is prohibited other than in accordance with applicable laws.

·   Your use of this Website, and any dispute arising out of such use, is subject to the laws of Hong Kong.

 

ONLINE RESERVATION

 

By using the online reservation of this Website, you agree to the Terms including without limitation the following:

 

Your Reservation


When you make an online booking with the Restaurant, you are entering into a direct contract with us. To use the online booking, you must be at least 18 years old.

 

To make a reservation, you have to provide your full name, phone number and email address, along with other information that may be required by us. By providing your email address, you agree to receive information about your reservation via email. We may require that you provide your credit card information to make a reservation or to pay us a deposit. You warrant and represent to us that all information that you provide to us is true, accurate and complete.

  

Reservation confirmation


When you place an online booking, you are making an offer to the Restaurant to accept your booking. All reservations are subject to the availability of the Restaurant for your specified time, date and party. Your booking is not complete nor legally binding on the Restaurant unless and until you have (1) received a confirmatory email or booking confirmation receipt from the Restaurant accepting your booking details, and (2) paid the required deposit, where applicable. Our email confirmation will be sent to the email address that you enter. We are not responsible for any direct or indirect loss or inconvenience suffered by you or any other persons if you have entered an incorrect email address or any other inaccurate information.

 

You agree to, if we request, show us a copy of the email confirmation or other evidence of confirmation upon arrival.

 

Your booking confirmation will secure your table reservation for up to 15 minutes from the reserved time. If you fail to arrive at the Restaurant before the expiry of such 15 minutes for whatever reason, your reservation will be treated as a ‘no show’.

 

A table will be available to you for a maximum of 2 hours. Any request for extension of time is subject to availability and our absolute discretion.

 

No food or beverages except those supplied by the Restaurant may be consumed at the Restaurant. If you would like to bring your own cake and/or beverages, you agree to notify the Restaurant at the time of booking and seek our approval. We reserve the right to disallow their consumption at the Restaurant, or if approved, to charge a fee for handling or for corkage.

 

If there is any change in the number of people attending, you agree to give us at least 72 hours’ notice so that we may try to accommodate such changes. A table for an increased number of guests is not guaranteed and is subject to availability.

 

Cancellations, No Shows And Refunds

 

You agree to give us at least 72 hours notice if you intend to cancel or change your reservation. Such notice must be given to us through our online reservation system, or by email to: reservations@thechairmangroup.com.

 

There shall be no refund of deposit paid if cancellation or change is notified to us for less than 72 hours before the reserved time.

 

Any deposit paid shall be forfeited by us in the event of a “no show” for whatever reason. You agree and accept that this is a reasonable compensation to us.

 

We reserve the right to cancel any booking, and in that case, the deposit paid shall be refunded.

 

Special Dietary Requirements

 

If you have any food allergy, intolerance or sensitivity, you agree to notify us at the time of booking. Please also inform your server upon arrival.

 

 

Use of the Website

 

We do not warrant or guarantee that the Website will be available or working in order at all times.

 

We may, in our sole discretion and for any reason or no reason, suspend or terminate your access to the Website or discontinue any services offered at any time, with or without notice.

 

We shall not be liable to you or any other persons for any such termination, or for the suspension or inaccessibility of the Website for any reason whatsoever.

This privacy policy statement (“this Privacy Statement”) of The Chairman Company Limited (“The Chairman”) explains how personal data is collected and used by The Chairman.

 

Accessing or utilizing services on www.thechairmangroup.com or its Facebook fans page (collectively, “this Website”) or The Chairman mobile applications (“these Apps”) means that you have accepted and agree to be bound by the terms of this Privacy Statement. The Chairman reserves the right to change or modify the contents of this Website or these Apps at any time and unilaterally change this Privacy Statement without notification. Your continued use of this Website indicates your acceptance of any change to this Privacy Statement, including without limitation modifications which might materially affect the way we use or disclose your information (including your personal data) (“Data”). “You”, and “users” refer to any person that accesses this Website or these Apps for any reason.


1. Collection of Data and its purposes

 

When you use this Website or these Apps, you may have to provide to The Chairman your Data including but not limited to your name, gender, age, contact details, email address, credit card information and facebook ID. You agree to provide to The Chairman such information voluntarily. You agree and understand that any and all of the Data you provided to The Chairman will be collected and used as follows:

(a) for verification of identity and record; (b) for displaying on the relevant portal when you use this Website, these Apps, the Internet and other channels in managing your Data; (c) for analysis and for comparison with others’ Data in order to develop The Chairman’s products or services and market promotion programmes; (d) for communicating with you offers and promotions in relation to food and beverage and catering services provided by The Chairman and business partners in joint promotions; (e) for storing communication contacting details; (f) for generating survey on user traffic on this Website; (g) for processing of your orders and service requests; (h) for collecting payment, processing of any payment instructions and direct debit fees; (i) for internal monitoring, including calculating any amount you should receive or owe, make payment to or request payment from you, and collecting any fees or enforcing guarantee granted to or granted by the users; (j) for facilitating daily operation of your account; and (k) for implementing your instruction, making reservations, responding to your enquiries or those made in your name, and providing efficient and responsive service.

 

2. Personal Data (Privacy) Ordinance

 

The Chairman complies with Hong Kong laws including Personal Data (Privacy) Ordinance.

 

3. Retention, storage and disclosure of Data

 

You acknowledge, agree and authorize us to retain and store the Data you provided in one or more databases of The Chairman within or outside Hong Kong, and to provide, disclose, access and transfer such Data to:

(a) any employee of The Chairman who are authorized to handle such Data for the purposes for which such Data are collected; (b) any contractor or agent which provides administrative, telecommunication, computer, payment, insurance, professional or other services to The Chairman  and is engaged by The Chairman for the purposes for which such Data are collected or relevant to the purposes for which such Data are collected; (c) anyone that The Chairman has to make disclosure to in accordance with the requirements of applicable laws, administrative policies or regulations; (d) anyone who reasonably requires The Chairman to make disclosure in order that The Chairman can implement the purposes listed in this Privacy Statement.

You agree that The Chairman can disclose your Data in the following reasonable and necessary circumstances: (i) in compliance with relevant laws; (ii) to execute or implement any terms of use relating to your use of this Website, these Apps or the services provided by The Chairman ; (iii) to protect rights, properties or interests of The Chairman, employees, agents, customers and users; or (iv) in compliance with this Privacy Statement.

The Chairman has not and will not sell your Data. The Chairman also will not provide, disclose, allow access and transfer your data to any third party other than the above.

The Chairman will retain your Data after you have provided your Data via this Website or these Apps. Your Data will be retained for not more than the period permitted by law after the termination of the purpose for which you provided your Data, and thereafter erased.

 

4. Security of Data

 

Owing to the nature of Internet, The Chairman cannot guarantee the security on any transfer of Data. However, The Chairman will take reasonably practical measures to ensure any Data collected by this Website or these Apps will not be intercepted by any third party. You must be clear that The Chairman advertisers or any website with links to this Website may collect your Data. You must read the relevant privacy statement carefully before you provide your Data to them. Your provision of your Data to any third party has nothing to do with The Chairman and The Chairman will not have any responsibility on such. If The Chairman receives relevant Data from a third party, it will retain the information in the usual strict secured and confidential standards.

You are aware that according to Personal Data (Privacy) Ordinance, you have the right to access your personal data held by The Chairman and request amendment to your personal data.
